A North Carolina nursing home agreed to pay $350,000.00 to the family of a resident who fell from her bed and died two weeks later.
The family claimed that the nursing home was negligent in failing to properly restrain the deceased. As a result, the family claimed, their relative fell from the bed and broke her hip.
The deceased was found lyin on the floor but was not taken to the hospital until several hours later.
The resident died approximately two weeks after surgery to repair her broken hip.
There has been increasing concern throughout the country for residents of nursing homes who are injured or die as a result of improper treatment. The problem usually arises from insufficient staffing.
In an alarming number of cases, nursing homes not only fail to provide the proper number of personnel, but the personnel they hire are under-trained. The work is different and the wages paid to nursing home employees are often low.
In the past, neglect or sometimes even abuse, of nursing home residents was not properly addressed by the courts. It was difficult to find lawyers to represent residents of nursing homes because of a concern that juries would not adequately compensate these residents for their injuries. Nursing homes would argue that, since the victim is elderly and had no earned income, the financial consequence of their injuries or death was minimal. However, in recent year, lawyers are taking cases of injured and abused nursing home residents. More importantly, juries have demonstrated a willingness to adequately compensate for these injuries even though the victims are usually elderly.
