Sears Sued For Defective Radial Arm Saw

Brent AdamsJanuary 01, 2008 2:24 AMA man from Godfrey Illinois who received a personal injury while using a radial arm saw has filed a suit against Sears and Emerson Tool Co. He alleges that the defendants failed to warn of the saw's dangers.
According to the claim of Alvin Wellenreiter, while he was using a radial arm saw from Sears at the home of his father on December 19 in 2005, his left fingers were cut by the saw's blade, resulting in severe injuries.
According to Wellenreiter's suit, filed on December 18 in the Circuit Court of Madison County, at the time of manufacturing, marketing, and sale of the saw, the defendants were careless and negligent by failing to adequately warn of the dangers of using certain saw blades while operating the saw.
According to Wellenreiter, the defendants failed to place a guard at the places people were likely to come in contact with the blade and have limbs cut. He also claims they failed to provide devices that are adequate for preventing kickbacks during the saw's operation.
Also alleged by Wellenreiter is that the defendants inadequately designed the hooks on the "Excalibur Dado" blade and failed to warn of the dangers of operation of certain saws and performance of certain cuts.
According to Wellenreiter's claims, the sustained permanent injuries to his left hands and limbs, and severe injury to his nervous system which caused great pain, medical expenses and lost wages. He seeks damages in excess of $100,000 plus costs.
